HB5373 - Thermal Receipt Paper Act (Amendment)

• Prohibits sale, distribution, and use of thermal receipt paper containing bisphenol-A (BPA) beginning January 1, 2015.

• Paper manufacturers and distributors cannot sell or distribute BPA-containing thermal receipt paper in Illinois; all persons prohibited from using such paper for commercial transactions.

• Paper manufacturers, distributors, or users may request a delay in prohibitions before January 1, 2014 if no safer BPA substitutes are commercially available by the deadline.

• Illinois Environmental Protection Agency must maintain website information on recycling and disposal best practices for thermal receipt paper and conduct outreach to businesses about compliance requirements.

• Civil penalties range from $2,500 first violation to $5,000 for subsequent violations for manufacturers/distributors; $250 first violation to $500 for subsequent violations for users; penalties enforced by State's Attorney or Attorney General.
