HB 5470 - Used Wireless Communication Device Dealer Act

• Defines a used wireless communication device dealer as any business entity that uses cash to purchase previously owned cellular telephones for resale or recycling purposes.

• Requires dealers to obtain identification from sellers (driver's license, social security card, utility bill, or other acceptable forms) and maintain a record book with the seller's name and residence address.

• Mandates dealers record the device make, model, serial/identification numbers, any passwords or passcodes, and the amount paid for each device at the time of sale.

• Requires dealers to maintain records for at least 2 years and make them available for inspection and copying by law enforcement upon request; prohibits erasing, mutilating, or altering any record entries.

• Establishes penalties of a Class C misdemeanor for first offense and Class A misdemeanor for subsequent offenses for knowing violations; exempts wireless service providers and insurance-licensed entities and their affiliates from the requirements.

• Takes effect January 1, 2013.
