Operation of a licensed day care home in a residential dwelling is considered incidental to primary residential use and constitutes a valid residential use under community instruments.

Community instruments cannot interpret day care home operation as a business, commercial activity, or trade.

Associations cannot prohibit use of a residential dwelling as a day care home unless the community instrument specifically includes such a prohibition.

Condominiums, timeshares, and cooperatives are exempt from these requirements.
