HB5623 - Kids Play Safe Act

• Creates the Kids Play Safe Act to regulate indoor play structures in food establishments and other facilities where children play.

• Declares unsanitary indoor play structures, filthy buildings with children's play areas, improperly disinfected play areas, and unsafe play structures as public nuisances dangerous to public health.

• Requires county or municipal boards of health to order removal of nuisances within 24 hours; violations are Class C misdemeanors with fines up to $500.

• Makes food establishment owners or operators guilty of Class C misdemeanors if they fail to correct known unsanitary conditions or maintenance problems within 24 hours.

• Makes board of health members or local health department officers guilty of Class C misdemeanors if they criminally negligently fail to perform duties under the Act.
