HB5624 Summary

• Creates a new meter-exempt parking decal for persons with disabilities beginning January 1, 2014, available to those unable to manipulate coins/tickets, reach parking meters (above 42 inches), approach meters due to mobility devices, or walk more than 20 feet due to severe orthopedic, neurological, cardiovascular, or lung conditions.

• Requires physician, physician assistant, or advanced practice nurse certification for meter-exempt decal applications, and allows parents/guardians of disabled persons under 18 incapable of driving to obtain the decal.

• Increases penalties for unauthorized use of disability parking privileges: first offense $600 (up from $500), second offense $750, third or subsequent offense $1,000, with 50% of fines distributed to law enforcement.

• Adds new felony provisions making it a Class A misdemeanor (minimum $1,000 fine) or Class 4 felony (minimum $2,000 fine) for physicians, physician assistants, or advanced practice nurses to knowingly falsify disability certifications.

• Allows police officers to seize parking decals/devices and request revocation of disability credentials for violations related to unauthorized use or fraudulent documentation.
