HB5681 - Armed Citizen Liability Act

• Provides civil liability immunity for use of force intended or likely to cause death or great bodily harm if the person reasonably believed force was necessary to prevent imminent death or bodily harm to themselves or another person.

• Immunity applies when force is used against someone unlawfully and forcibly entering or already inside a dwelling, motor vehicle, or place of business, and the property owner knew or had reason to believe an unlawful forcible entry was occurring.

• Prohibits finder of fact from considering whether the person using force had opportunity to flee or retreat before using force.

• Presumes the person using force reasonably believed force was necessary to prevent imminent harm, except when the person was engaged in criminal activity or the target was a public safety worker performing official duties.

• Requires courts to award reasonable attorney's fees, costs, lost income compensation, and other litigation costs to anyone found immune from civil liability under this act.
