HB5718 - Prisoner Census Adjustment Act

• Creates the Prisoner Census Adjustment Act to adjust census population counts by reassigning incarcerated persons to their pre-incarceration addresses for purposes of redistricting and election district creation.

• Requires the Secretary of State to prepare and disseminate adjusted population counts within 30 days after the U.S. Census Bureau publishes decennial census redistricting data.

• Mandates that all State and local governmental entities operating incarceration facilities submit reports to the Secretary of State by May 1 of the census year, including names, demographics (age, gender, race), and last known pre-incarceration addresses of prisoners with less than 4 years remaining on their sentences.

• Requires the Secretary of State to reassign prisoners identified in reports to their last known addresses (if in Illinois) and remove them from facility location population counts in all census categories.

• Requires all State and local political subdivisions conducting redistricting to use the adjusted population counts prepared by the Secretary of State, unless exceeding adjusted limits is necessary to comply with federal law; effective January 1, 2020.
