• Repeals Section 10.1 of the Sanitary Food Preparation Act and creates new Section 10.2 establishing menu misrepresentation prohibitions for eating establishments.

• Makes it unlawful for any person or business to misrepresent the identity of food or food products on menus, posted information, or advertisements to patrons or customers of restaurants, hotels, cafes, and similar food service establishments.

• Exempts retail food or grocery stores that do not provide on-premises food consumption facilities from the menu misrepresentation requirements.

• Defines misrepresentation to include false or misleading descriptions, omitted information that renders descriptions misleading, imitation or substitute products, foods served under another food's name, and foods not conforming to established definitions and standards of quality.

• Requires local health departments that publish violations of law, regulation, or ordinance to also publish occurrences of menu misrepresentation violations.
