HB6179 Summary

• Amends the Workers' Compensation Act to define "accident" as an occurrence arising out of employment, resulting from employment-related risk, occurring at a time and place reasonably required by employment.

• Defines "injury" as a medical condition arising out of and in the course of employment that must be established to a reasonable degree of medical certainty based on objective medical findings.

• Requires the accidental compensable injury to be the "major contributing cause" (more than 50% responsible) of any resulting injuries, with all causes and manifestations established by medical certainty.

• Includes aggravation of pre-existing conditions as compensable injuries only when the aggravation continues to be the major contributing cause of disability.

• Excludes from compensation any injury resulting directly or indirectly from idiopathic causes (causes arising spontaneously or from unknown origin).
