• Amends the Workers' Compensation Act (820 ILCS 305/11) to modify the legal standard for intoxication as a cause of workplace injuries.

• Changes the rebuttable presumption regarding intoxication by allowing employees to overcome it by showing intoxication was not the proximate cause (removes language requiring proof it was not the "sole proximate cause").

• Establishes a rebuttable presumption of intoxication as the injury cause when an employee has 0.08% or more alcohol by weight, shows impairment from controlled substances or cannabis, or refuses testing.

• Requires the Illinois Workers' Compensation Commission to adopt rules governing sample collection and testing that comply with federal labor standards, protect individual privacy, use split testing procedures, and employ nationally accepted analytical methods.

• Applies only to accidental injuries occurring on or after September 1, 2011.
