HB 6237 Amendment Summary

• Amends Illinois Procurement Code Section 1-10 to require all grants to be subject to filing requirements under Section 20-80, regardless of exemption status.

• Requires not-for-profit agencies receiving exempt grants or providing exempt purchase-of-care services to submit IRS Form 990 (Parts IV, Schedule L; Part IV, Schedule R; and Part VI, Schedule O) disclosing ownership interests, partnerships, business transactions with for-profit affiliates, and whether over 50% of officers/directors/key employees benefit from related for-profit relationships.

• Amends Section 45-35 to add identical IRS Form 990 disclosure requirements for not-for-profit agencies participating in the State Use Committee program for procuring products and services from persons with severe disabilities.

• Modifies Section 1-10 to renumber subsection (h) as subsection (i) and clarifies that chief procurement officers may access records to determine contract applicability to procurement code, except attorney-client privileged materials.
