• Amends the Illinois Public Aid Code to establish payment methodologies for nursing facilities and intermediate care facilities (ICF/DD), with rates set prospectively based on historical financial data updated for inflation, effective July 1 each year.

• Implements a Minimum Data Set (MDS) nursing component payment methodology effective July 1, 2003, with transition protections preventing rate decreases and allocating $60 million (2007), $110 million (2008), and $194 million (2009) in additional funding subject to federal approval.

• Imposes a long-term care provider assessment of $6.07 per occupied bed day, due monthly, with provisions allowing payment delays for financially struggling providers and establishing a Long-Term Care Provider Fund for disbursements to nursing facilities and administrative expenses.

• Establishes enhanced payments for facilities serving exceptional needs residents (ventilator care, bariatric care, traumatic brain injury, etc.), allocating at least $8,000,000 from assessment funds, contingent on federal State Plan amendment approval.

• Requires federal approval of payment methodologies and tax waivers under 42 CFR 433.68 before increased payments become due and payable, with all prior increases payable within 90 days of federal approval notification.
