SB1875 - Responsible Bidder in Service Contracts Act

• Applies to public service contracts of $2,000 or more or $200 or more per month, requiring awards to the lowest responsive and responsible bidder.

• Establishes mandatory criteria for "lowest responsible bidder" including compliance with tax identification, equal employment opportunity laws, insurance requirements, prevailing wage provisions, health and pension plans, and professional licenses.

• Disqualifies bidders who violate prevailing wage provisions twice within 3 years for 4 years after the latest violation, with violators added to a debarment list posted on the Department of Central Management Services website.

• Requires bidders to remain neutral in union organizing campaigns and prohibits use of public funds to influence employee unionization decisions.

• Creates a private right of action allowing employees and interested parties to sue in circuit court for wage violations, compensatory damages up to $500 per violation, and attorney's fees, with a 3-year statute of limitations.
