Department of Transportation shall implement by January 1, 2013 a pilot program allowing direct state payment to subcontractors on select construction contracts if work is performed properly and accepted.

Pilot program applies only to state-funded construction contracts under $10 million in value with subcontracts for work performed exclusively and completely by the subcontractor.

Contractor must deliver proper bills or invoices to the Department for each subcontractor to facilitate direct payment under the pilot program.

Secretary of Transportation may exempt contracts from the pilot program if administratively burdensome; program expires January 1, 2014.

Department and Comptroller shall report to General Assembly on pilot program results and recommendations for continuation or improvements.
