IL SB3351

Amends Section 107A-5 of the Code of Criminal Procedure of 1963 regarding lineup and photo spread procedures.

Requires all lineups to be photographed or otherwise recorded, with photographs disclosed to the accused and defense counsel during discovery proceedings.

Mandates that all photographs of suspects shown to eyewitnesses during photo spreads be disclosed to the accused and defense counsel during discovery proceedings.

Requires each eyewitness viewing a lineup or photo spread to sign a form stating that the suspect might not be present and that the eyewitness should not assume the administrator knows which person is the suspect.

Prohibits suspects in lineups or photo spreads from appearing substantially different from fillers or distracters based on the eyewitness's previous description or other factors that would draw attention to the suspect.
