IL SB3404

Changes the Department of Human Services payment system from "equitable" to "actuarially sound" to adequately fund the cost of providing services to persons with mental illness, developmental disabilities, and substance use dependencies.

Requires the Department to ensure individuals receiving community-based services have those services funded according to their independent assessment plans and receive the same array of services as those in court-ordered consent decree programs or transitioning from closed State facilities.

Establishes a 13-member commission by September 1, 2009 to review funding methodologies, identify funding gaps and revenue sources, and prioritize funding for developmental disability, mental health, substance abuse, rehabilitation, and early intervention services.

Prohibits caps on total annual payments to providers for entitlement services under federal law and prohibits deferring payments to subsequent fiscal years based on yearly payment caps.

Takes effect immediately upon becoming law.
