SB3411 Summary

• Requires all accident and health insurance policies and managed care plans covering prescription drugs to allow participants to fill mail order prescriptions at any network participating retail pharmacy if that pharmacy accepts a price comparable to the mail order pharmacy.

• Prohibits insurance policies from imposing different co-payment fees or other conditions on insureds purchasing drugs from network retail pharmacies versus designated mail order pharmacies.

• Applies to group and individual policies amended, delivered, issued, or renewed after the effective date of the 97th General Assembly.

• Exempts collective bargaining agreements and policies resulting from collective bargaining between employers and recognized employee organizations from these prescription drug requirements.

• Extends prescription drug coverage requirements to state employees, counties, municipalities, and school districts that provide health insurance benefits.
