SB3432 Summary

• Creates offense of failure to report death of a child when parent, guardian, or custodian discovers death from violence or trauma and fails to report to law enforcement within 12 hours, punishable as Class 4 felony.

• Establishes affirmative defenses for child death reporting offense if person reasonably believed death was already reported, a physician certified the death, or investigation by law enforcement or Department of Children and Family Services commenced within 12 hours.

• Creates offense of failure to report missing child age 13 or younger when parent, guardian, or custodian knew or should have known child was missing and fails to report to law enforcement within 24 hours, punishable as Class 4 felony for first offense and Class 3 felony for subsequent offenses.

• Provides affirmative defense for missing child reporting offense if person reasonably believed a missing person report was already made to law enforcement.

• Becomes effective immediately upon enactment.
