SB3558 Summary

• Amends Section 1A-4 of the School Code concerning powers and duties of the State Board of Education with a technical grammatical change (changes "The" to "The").

• State Board of Education appoints the State Superintendent of Education under a performance-based contract linked to statewide student performance and academic improvement.

• State Superintendent contracts must expire no later than February 1 every 4 years beginning February 1, 2007, with new appointments required at the beginning of each Governor's term after Board appointments are made.

• State Board may delegate authority to the State Superintendent only through adopted board policy for ministerial functions, but cannot delegate authority to nonrecognize districts, withhold state payments as penalties, or make final contested case decisions under the Illinois Administrative Procedure Act.

• Board must prepare annual reports to the General Assembly and Governor containing education status analysis, school district compliance failures, and statewide high school dropout rates by grade level, sex, and race.
