SB3624 Summary

• Adds Illinois Street Gang and Racketeer Influenced and Corrupt Organizations Law (RICO) as Article 33G to the Criminal Code of 1961 to address organized crime and street gang activity.

• Prohibits persons employed by or associated with any enterprise from conducting or participating in the enterprise's affairs through a pattern of predicate activity (specified serious crimes) or collection of unlawful debt, or from acquiring/maintaining interest or control in any enterprise or property through such means.

• Establishes predicate activities including murder, kidnapping, sexual assault, robbery, burglary, arson, drug trafficking, weapons violations, and other felonies punishable by more than one year imprisonment; pattern requires at least 2 occurrences within 10 years.

• Imposes Class X felony penalties with 10-30 years imprisonment (or higher sentence for underlying predicate activity) plus restitution and fines up to $250,000 or twice the proceeds; enhanced sentences of 25 years to life apply if deaths result; probation and suspended sentences are prohibited.

• Authorizes civil remedies including disgorgement of illicit proceeds, restrictions on future activities, and dissolution of criminal enterprises; violations subject to forfeiture procedures under money laundering statutes; actions must commence within 5 years unless resulting in death.
