Employers cannot require employees to work more than 40 hours per week without paying overtime compensation at a rate not less than 1.5 times the regular wage.

Overtime requirements do not apply to certain exempted categories including automobile/farm implement salespeople, trailer/boat/aircraft salespeople, agricultural workers, and government employees excluded under federal law.

Executives, administrators, and professionals earning at least the federal minimum salary threshold are exempt from overtime requirements, with the Director authorized to set lower thresholds for not-for-profit corporation employees.

Employees receiving remedial education in basic skills (for those lacking a high school diploma) may work up to 10 additional hours per week without overtime pay if the education excludes job-specific training.

Union employees in bargaining units recognized by the Illinois Labor Relations Board whose contracts allow alternate shift schedules under federal law are exempt from the 40-hour overtime requirement.
