SB3638 - Sex Offender Evaluation and Treatment Provider Act

• Establishes licensing requirements for sex offender evaluators, treatment providers, and associate sex offender providers through the Department of Financial and Professional Regulation.

• Creates an 8-member Sex Offender Evaluation and Treatment Licensing and Disciplinary Board including treatment professionals, representatives from corrections/courts/probation, and public members to advise on licensure and discipline.

• Requires applicants to hold relevant professional licenses (physician, psychologist, clinical social worker, counselor, or marriage/family therapist), complete 400 hours of supervised experience with sex offenders (200 face-to-face), and obtain 40 hours of sex offender-specific training.

• Mandates that sex offender evaluations and treatment services for compliance with the Sex Offender Management Board Act, Sexually Dangerous Persons Act, and Sexually Violent Persons Commitment Act must be provided by licensed providers as of January 1, 2014.

• Establishes continuing education requirements of 20 hours per renewal period and grounds for license denial, suspension, or revocation including criminal convictions, professional incompetence, and unprofessional conduct.
