IL SB3701

Adds new subsection (c) to Section 108-3 authorizing judges to issue search warrants for the installation and use of tracking devices upon written complaint showing probable cause.

Defines "tracking device" as an electronic or mechanical device permitting tracking of the movement of a person or object, with warrants limited to 45 days initially and renewable for additional 45-day periods upon showing good cause.

Requires tracking device installation to be completed within 10 days of warrant issuance and permits installation at any time of day or night, with warrant specifying the person or property to be tracked and designating the judge to whom it must be returned.

Establishes that tracking device warrants authorize use within Illinois and outside Illinois if the device was installed in Illinois or if interception occurs in Illinois.

Requires officers to notify the tracked person or property owner within 10 days after tracking ends and permits judges to delay notice upon request of the State.
