SB3747 Summary

• Changes Department of Human Rights from discretionary "may" to mandatory "shall" administratively close charges when the same issues are being litigated in state or federal court.

• Extends the Department's deadline to issue its investigation report from 100 days to 365 days after a charge is filed, or longer if all parties agree in writing.

• Allows aggrieved parties to file their own complaint with the Human Rights Commission or commence a civil action if the Department fails to issue its report within 365 days, with a 90-day window to do so.

• Requires the Department to immediately cease investigation and dismiss charges if an aggrieved party files a complaint or civil action; failure to do so allows courts to permanently enjoin the investigation and hold the Department liable for respondent's costs, attorney's fees, and damages.

• Removes the Director's requirement to make investigative information available to parties upon request after investigation completion.
