• Department of Children and Family Services must file a petition in circuit court requesting the Office of State Guardian be appointed as guardian for persons with intellectual or developmental disabilities who reach age 21 while receiving child residential services in a Department-licensed facility.

• State Guardian appointment, if granted by the court, shall commence on the person's 21st birthday and continue until the day before their 22nd birthday.

• Department must file guardianship petitions in a timely manner to ensure guardianship begins on the affected person's 21st birthday if approved by the court.

• Effective immediately upon becoming law.
