Senate Resolution 821 expresses concerns that Illinois Commerce Commission orders in Dockets 11-0721 and 12-0001 fail to comply with Public Acts 97-616 and 97-646 regarding the Energy Infrastructure Modernization Act.

The resolution affirms the ICC correctly reversed itself to allow Commonwealth Edison Company to recover a debt return on pension assets as permitted under Section 16-108.5 of the Public Utilities Act.

The resolution urges the ICC to order Commonwealth Edison Company and Ameren Illinois Company to file tariff changes correcting the interest rate methodology, using final year-end values for rate base, and fixing other errors by December 31, 2012.

The resolution requests that participating utilities be permitted reasonable time to comply with infrastructure investment schedules without penalty or adverse action.
