Charitable organizations employing law enforcement personnel, firefighters, or other public safety employees may solicit for charitable purposes on public roadways, including from passing motorists, if requirements are met.

Charitable organizations must file applications with the county or municipality at least 10 business days before solicitation begins, including proposed dates, times, locations, manner of solicitation, and proof of $1,000,000 liability insurance.

Applications must list 3 alternate locations in order of preference; if the primary location is denied due to significant safety concerns (high traffic, poor road geometry, construction, accidents), the county or municipality must approve one of the alternate locations.

County and municipal authorities must approve applications within 5 business days and may impose reasonable conditions based on articulated public safety concerns, but cannot prohibit charitable solicitations that meet all requirements.

Home rule units cannot regulate charitable organizations in a manner inconsistent with these provisions, and local agencies do not waive immunity from liability by approving applications.
