HB1009 Summary: "Kelsey's Law"

• Requires applicants under 18 to hold an instruction permit for minimum 9 months, complete driver education, and have 50 hours of behind-the-wheel practice (at least 10 hours at night) before receiving a graduated license.

• Mandates applicants under 18 meet school attendance requirements by graduating high school, enrolling in GED courses, being enrolled in school, or receiving home instruction at time of application.

• Prohibits graduated license holders under 18 from operating vehicles with more than one passenger under age 20 in front seat (except siblings and children); restricts passenger limit in back seats to available safety belts.

• Denies graduated licenses to applicants under 18 with pending traffic citations, prior convictions for drug/substance violations while in control of a vehicle, or certain serious traffic violations; requires 9-month waiting period after traffic convictions before license issuance.

• Adds provision allowing courts to invalidate driver's licenses or permits when a citation violation is the proximate cause of another person's death or Type A injury.
