HB1010 Summary

• Adds new subsection (r) to Illinois law prohibiting court supervision for defendants charged with any Illinois Vehicle Code violation if the violation caused another person's death and the defendant has a prior conviction or court supervision for any non-equipment vehicle code violation, or a suspension/revocation/cancellation of driver's license.

• Adds new subsection (q) prohibiting court supervision for defendants charged with speeding in excess of 25 miles per hour over the posted speed limit in an urban district.

• Maintains existing restrictions on court supervision for repeat traffic offenders, DUI violations, reckless homicide, driving with revoked license, and other specified vehicle code violations.

• Requires courts to impose structured intermediate sanctions for probation violations and allows probation agencies to invoke sanctions from a judge-approved list.

• Requires defendants receiving supervision for vehicle code violations to pay additional fees: $29 to the state vehicle fund and $6 (split between circuit court operations and Prisoner Review Board) as applicable.
