IL HB1029

Establishes the Uniform Collaborative Law Act to create a legal framework for collaborative law processes in family and domestic relations matters, including divorce, child custody, alimony, adoption, and related agreements.

Requires collaborative law participation agreements to be in writing, signed by parties, identify collaborative lawyers representing each party, and describe the nature and scope of the matter being resolved.

Disqualifies collaborative lawyers and their law firm associates from appearing before tribunals in proceedings related to the collaborative matter, except to seek tribunal approval of agreements or emergency protective orders.

Creates a privilege protecting communications made during collaborative law processes from discovery and admission as evidence, with exceptions for public records, threats of violence, criminal activity, and abuse/neglect cases.

Requires collaborative lawyers to assess whether the process is appropriate, disclose material benefits and risks compared to alternatives, inquire about coercive or violent relationships, and ensure parties understand the process terminates if litigation is initiated.
