IL HB1139

Establishes the Gang Crime Witness Protection Program administered by the Illinois Criminal Justice Information Authority to assist victims and witnesses aiding in prosecution of gang crimes.

Defines "gang crime" as any criminal offense committed by a gang member in furtherance of gang activity, as defined in the Illinois Streetgang Terrorism Omnibus Prevention Act.

Funds assistance limited to temporary living costs, moving expenses, rent, security deposits, and other relocation or transition expenses for eligible witnesses and victims.

Requires counties to fund at least 25% of assistance costs to qualify for state reimbursement of up to 75%, with no single county receiving more than 50% of annual funding.

Creates the Gang Crime Witness Protection Program Fund in the State Treasury, with the program beginning operation on July 1, 2013, and retains 2% of distributed funds for administrative purposes.
