Municipalities in counties with populations of 2,000,000 or more must regulate and inspect retail food establishments according to federal and state laws, except those served by certified local health departments other than county health departments.

Home rule units cannot regulate retail food establishments in a less restrictive manner than required by this section.

Municipalities may enter intergovernmental agreements with county certified local health departments to perform inspection functions, with municipalities paying reasonable costs.

Municipalities may also enter intergovernmental agreements with local health districts serving the entire municipality to regulate and inspect retail food establishments.

Intergovernmental agreements do not prevent municipalities or local health districts from continuing to license retail food establishments within their jurisdictions.
