Department of Human Services may require substance abuse testing as a condition for Temporary Assistance for Needy Families (TANF) program eligibility.

Pilot program must be implemented in at least 3 counties with random testing before statewide rollout, contingent on evaluation submission and 6-month waiting period after evaluation is submitted to General Assembly.

Individuals testing positive must have sample retested to rule out false positives, complete substance abuse assessment, and comply with required treatment plan; noncompliance penalized consistent with Section 4-1.9 violations.

Department must submit annual report to General Assembly including number of individuals tested, test results, treatment referrals, testing costs, sanctions imposed, and percentage of TANF households with substance abuse positive results.

Testing exemptions apply to individuals 65 years of age or older and residents of facilities licensed under the Nursing Home Care Act or the ID/DD Community Care Act; act takes effect immediately.
