Prohibits operating a motor vehicle on a roadway while using a hand-held electronic communication device, including wireless telephones and personal digital assistants.

Establishes tiered fines for violations: $75 maximum for first offense, $100 for second, $125 for third, and $150 for fourth or subsequent offenses.

Exempts law enforcement officers, emergency responders, drivers reporting emergencies, and drivers using hands-free or voice-operated modes including headsets.

Exempts commercial motor vehicle drivers reading messages on permanently installed devices (10 inches by 10 inches maximum), drivers parked on roadway shoulders, and drivers stopped in traffic with transmission in neutral or park.

Exempts drivers using two-way radios, citizens band radio services, amateur radio, single-button voice controls, and multi-function devices used for purposes other than hand-held communication.
