HB1293 - Condominium Ombudsperson Act Summary

• Creates the Office of the Condominium Ombudsperson within the Attorney General's office, effective July 1, 2013, to provide education, training, and dispute resolution assistance for condominium property matters.

• Requires the Ombudsperson to maintain a statewide toll-free number, operate a website with relevant laws and dispute resolution resources, and offer training courses on condominium operation and unit owner rights.

• Mandates that all condominium board members certify within 60 days of taking office that they have read the condominium instruments and this Act or its summary.

• Establishes an annual fee structure where every unit owners' association pays per-unit fees (initial rate of $3 per unit, capped at $10 per unit) deposited into the Condominium Ombudsperson Fund to cover office operations.

• Requires the Attorney General to submit annual reports to the General Assembly detailing workload data and recommendations on expanding the Ombudsperson's enforcement authority and oversight responsibilities; the Act repeals on July 1, 2016.
