Department of Human Services must establish a substance abuse testing program within 60 days as a condition of eligibility for Temporary Assistance for Needy Families (TANF) benefits using emergency rulemaking procedures.

All TANF applicants must submit to substance abuse testing before a final eligibility determination is made.

Applicants who test positive for substance abuse or refuse to submit to testing are ineligible for TANF benefits.

For applicants who test negative and meet all other TANF eligibility requirements, the cost of the substance abuse test is deducted from their first benefits payment.
