HB2269 Summary

• Extends the sunset date for notarial record requirements on residential real property transactions in Cook County from July 1, 2013 to July 1, 2018.

• Requires notaries to create detailed notarial records for documents conveying residential property (1-4 unit buildings or condominiums) including date, property PIN, street address, signer identification, thumbprint or fingerprint, and notary contact information.

• Notaries employed by title insurance companies, financial institutions, or attorneys must deliver original notarial records to their employer within 14 days for 7-year retention; independent notaries must file records with Cook County Recorder of Deeds for $5 filing fee.

• Protects notarial records containing fingerprint data from public disclosure except by court subpoena, and requires Cook County Recorder to notify signers of any security breach of fingerprint data.

• Allows notaries to charge up to $25 per notarial act performed under Section 3-102 (residential property transactions) in addition to the standard $1 maximum notarial fee.
