HB2332 - Cannabis Possession Amendment

• Allows county boards to adopt ordinances declaring possession of no more than 15 grams of cannabis a petty offense with county-determined fines, instead of criminal charges.

• Allows municipalities to adopt ordinances declaring possession of no more than 15 grams of cannabis a petty offense with municipality-determined fines.

• Permits sheriffs and peace officers to issue notices to appear rather than make arrests for possession of 15 grams or less if their jurisdiction adopts a uniform citation form.

• Amends the Cannabis Control Act to clarify these provisions apply only in counties or municipalities that have adopted such ordinances, while maintaining existing felony and misdemeanor penalties elsewhere.

• Protects local public entities and employees from liability for failing to enforce state cannabis laws in jurisdictions that have adopted the petty offense ordinances, except in cases of willful or wanton conduct.
