IL HB2341

Provides immunity from criminal charges for persons who seek or obtain emergency medical assistance for someone experiencing alcohol poisoning, provided evidence was acquired as a result of seeking help and the person remains at the scene until emergency responders arrive.

Excludes parents who served alcohol to minors in violation of law, members of fraternities/sororities (except the person calling for help), and individuals engaged in hazing from the immunity protection.

Grants immunity to persons under 21 years of age experiencing alcohol poisoning who seek or obtain emergency medical assistance if evidence for charges was acquired as a result of seeking that assistance.

Limits immunity availability when law enforcement has reasonable suspicion or probable cause for criminal activity based on information obtained prior to or independent of the emergency medical assistance call.

Prohibits persons from initiating or maintaining legal actions against law enforcement officers based on their compliance or non-compliance with this section.
