HB2412 Summary

• Amends the Criminal Code to allow triers of fact to infer reckless conduct in reckless homicide cases when a defendant violates wireless telephone restrictions in posted school zones (with children present) or construction/maintenance zones (with workers present).

• Adds Section 12-610.1 of the Illinois Vehicle Code (wireless telephone violations) as a basis for inferring reckless conduct, alongside existing violations of speed limits exceeding 20 mph over posted limits or Section 11-501 violations.

• Applies to reckless homicide cases where an unintentional death occurs while driving in the specified zones and the defendant was simultaneously violating one of the enumerated Vehicle Code provisions.

• Takes effect immediately upon becoming law.
