IL HB2434

Amends the Probate Act of 1975 to modify Section 11-5.4 regarding short-term guardianship appointments for unmarried minors and children likely to be born.

Allows parents, adoptive parents, or guardians to appoint a short-term guardian in writing without court approval, with the appointment effective for up to 365 days unless an earlier termination date is specified.

Requires the written appointment to be dated, identify all parties, be signed by the appointing parent/guardian in the presence of at least 2 credible witnesses (age 18+), and be signed by the appointed short-term guardian (not necessarily at the same time).

Prohibits appointment of a short-term guardian if another living parent with known whereabouts is willing and able to make day-to-day childcare decisions, unless that parent consents in writing to the appointment.

Adds new subsection (e-5) allowing courts to vacate any short-term guardianship appointment if a temporary custodian has been appointed under the Juvenile Court Act of 1987, provided the vacation is consistent with the minor's best interests.
