HB2446 Summary

• Amends Section 14-3 of the Criminal Code to add "officer-worn video camera" to exemptions allowing law enforcement to record conversations during enforcement stops or when emergency lights are activated.

• Creates new subsection (h-1) allowing officers to record conversations with uniformed peace officers present when there is reasonable suspicion that a person has committed, is committing, or is about to commit an offense.

• Establishes subsection (h-15) requiring law enforcement agencies to retain recordings from in-car cameras, officer-worn cameras, and taser cameras for 90 days minimum unless part of an arrest or criminal proceeding, with prohibition on altering or erasing recordings before the storage period expires.

• Adds subsections (h-5) and (h-10) to exempt recordings of utterances made by persons in police vehicles and recordings made simultaneously with taser or similar weapons equipped with cameras.
