IL HB2471

Amends Section 111-3 of the Code of Criminal Procedure to require charges in sexual offense cases to identify the victim by name, initials, or description.

Applies to offenses involving illegal sexual acts, including sexual offenses defined in Article 11 or Section 10-9 of the Criminal Code of 2012.

Allows the State to amend charges prior to trial to comply with victim identification requirements or provide written notification of aggravating factors.

Requires that any alleged fact used to increase penalties beyond the statutory maximum must be included in the charging instrument, provided to the defendant before trial, submitted to the trier of fact, and proved beyond a reasonable doubt.

Takes effect January 1, 2014.
