Rental companies must obtain written agreement from renters before selling a damage waiver at or before rental agreement execution.

Rental companies may void a damage waiver only for specific reasons including commercial use, racing activities, intentional/criminal acts, fraudulent misrepresentation, operation outside continental U.S., unauthorized drivers, or DUI convictions.

Collision damage waiver fees are capped at $12.50 per 24-hour rental day prior to January 1, 2014, and $13.50 per 24-hour rental day beginning January 1, 2014.

Damage waivers cannot be voided for damage during auto business operations such as repairing, servicing, testing, washing, parking, storing, or selling vehicles.

Act takes effect upon becoming law.
