HB2592 - Prevention of Gun Trafficking Act

• Requires any person engaging in the business of selling, leasing, or transferring firearms or ammunition to obtain a dealer permit from the Department of State Police, with violation constituting a Class 4 felony.

• Mandates all private firearm transfers between non-dealers go through a licensed firearms dealer permittee who must conduct background checks and comply with all federal, state, and local requirements.

• Establishes dealer permit application requirements including personal information, criminal history, employee background checks, property ownership proof, and written approval from local law enforcement.

• Requires firearm owners to report lost or stolen firearms to local law enforcement within 72 hours of discovery; first violation is a petty offense, second or subsequent violation is a Class A misdemeanor.

• Creates an internet-based background check system administered by the Department of State Police effective January 1, 2015, with database records accessible to law enforcement and maintained by licensed dealers.
