HB2782 - Employment Noncompete Agreement Act

• Creates the Employment Noncompete Agreement Act establishing enforceable noncompete agreements between employers and employees with specific validity requirements.

• Requires noncompete agreements be in writing and signed by both parties, and may prohibit solicitation of existing customers, clients, identified prospective customers, and employees during the post-employment restriction period.

• Limits post-employment restriction periods based on annualized compensation: 6 months for less than $50,000; 9 months for $50,000-$99,999; 12 months for $100,000-$149,999; and 18 months for $150,000 or more.

• Eliminates the requirement for employers to provide specific or additional consideration to enforce noncompete agreements.

• Makes prevailing parties in enforcement actions entitled to recover damages, costs, expenses, and reasonable attorney's fees; holds subsequent employers liable if they aid and abet employee breaches of valid noncompete agreements.
