Establishes mandatory chemical testing for drivers involved in fatal motor vehicle accidents, who are deemed to have given consent to breath, blood, or urine tests without requiring arrest.

Requires both a breath test and a blood or urine test be administered within one hour of law enforcement arrival at the accident scene or within one hour of apprehending a driver who fled the scene.

Modifies existing law for personal injury accidents to clarify that testing requires arrest and issuance of a traffic citation, except for equipment violations.

Authorizes law enforcement to request blood tests from medical personnel treating accident victims, provided testing does not interfere with patient care.

Imposes driver's license suspension effective on the 46th day after notice if a driver refuses testing or tests positive for alcohol (0.08+), drugs, or controlled substances, with provisions for administrative hearing and restricted driving permits.
