HB2978 Amendment Summary

• Amends Illinois School Code to require fingerprint-based criminal history records checks for all certified and non-certified applicants seeking employment at non-public schools after July 1, 2007, as a condition for obtaining "Non-public School Recognition" status.

• Non-public schools must check the Statewide Sex Offender Database and verify applicants have not been convicted of enumerated criminal/drug offenses listed in Section 21B-80 or other felonies within 7 years.

• Requires non-public schools to extend background check requirements to all contracted employees with direct daily pupil contact, including food service workers, bus drivers, and transportation personnel.

• Establishes that criminal history record information is confidential and may only be shared with school governing bodies, hiring decision-makers, and relevant authorities; unauthorized release violates the Criminal Identification Act.

• State Superintendent of Education shall reimburse non-public schools for fees paid to obtain criminal history records checks, subject to appropriations; takes effect July 1, 2013.
