IL HB3008

Eliminates the provision allowing judges to infer intent to disseminate child pornography based on possession of multiple copies of the same material.

Creates a new Class X felony with mandatory sentence of 9-40 years imprisonment for possession of more than one copy of the same film, videotape, or computer depiction containing child pornography.

Maintains existing criminal penalties for child pornography offenses, with Class X felonies for violations involving films or videotapes and Class 1 felonies for violations involving only photographs or still images.

Increases penalties for violations involving children under age 13, making such offenses Class X felonies with mandatory 9-year minimum sentences for first-time offenders with prior related convictions.

Preserves existing affirmative defenses, exemptions for law enforcement and treatment professionals, and asset forfeiture provisions related to child pornography materials and equipment.
