IL HB3009

Creates three separate offenses for criminal street gang recruitment under Illinois Criminal Code Section 12-6.4: recruitment on school grounds (Class 1 felony), recruitment of minors via threat (Class 1 felony), and general recruitment without threat requirement (Class 4 felony, or Class 3 felony if victim is a minor).

Expands criminal street gang recruitment law to cover threats made through Internet or telecommunications devices, not just in-person threats.

Establishes a new general recruitment offense (subsection a-6) that applies statewide without geographic or threat requirements, punishable as a Class 4 felony or Class 3 felony if the recruit is a minor.

Defines key terms including "school grounds" (K-12, community college, college, or university property including playgrounds), "minor" (under 18 years old), and references "criminal street gang" definition from the Illinois Streetgang Terrorism Omnibus Prevention Act.

Maintains existing school grounds recruitment offense (subsection a) as a Class 1 felony requiring knowledge and threat of physical force to recruit, solicit, or coerce gang membership.
